Hands-free driving: who is still responsible?
A car can steer and control its speed while the person behind the wheel still has a driving job. Understanding that job is more useful than choosing a feature by its name or automation level alone.
By Michael McLaughlin · AI assisted

Before comparing driving systems, decide which part of driving you would like help with. Perhaps it is the repeated steering and speed adjustments on a long motorway journey. Perhaps you want to reach a destination without being the driver at all.
Those hopes lead to different shortlists. Hands-free assistance can address the first while leaving supervision with you. Becoming a passenger requires a different arrangement. The position of your hands does not tell you which arrangement is in force.
The most useful question is simple: while this feature is working, what must the person do?
Six levels describe different jobs
The SAE scale runs from 0 to 5. The level describes the feature in use, not the badge on the car. SAE also makes clear that the taxonomy is not a safety standard.1
Here is a practical summary, drawing on NHTSA’s consumer explanation and SAE’s public scope. It is a guide to the roles, not operating instructions for a vehicle.12
| Level | What the system contributes | The person’s driving role |
|---|---|---|
| 0 | No sustained driving automation | You perform the driving task. |
| 1 | Continuous support for steering or speed | You drive, monitor and intervene as needed. |
| 2 | Continuous support for steering and speed | You still supervise continuously and intervene as needed. |
| 3 | Driving under defined conditions | You remain available to resume driving when required, including following an alert or evident malfunction. |
| 4 | Driving within its defined operating conditions, without needing a human fallback driver | You can be a passenger within that operation. |
| 5 | Driving across the conditions in which humans can drive | No human driver is needed. This describes a category, not an arrival date. |
For choosing transport, three distinctions matter most: assistance that you supervise, automation that still needs a takeover-ready person, and an operation where the occupants can be passengers.
A higher number changes the allocation of the driving task. It does not, by itself, demonstrate that a particular product avoids more crashes or suits your journey better.
Hands-free can still mean eyes on the road
Ford’s UK description of BlueCruise uses a helpful phrase: “hands-off, eyes-on.” Its driver-facing camera monitors gaze and head position to check attention.3 The ability to release the wheel is part of the assistance; it does not make the driver a passenger.
Tesla’s US-facing support page is equally explicit about the named Full Self-Driving (Supervised) feature. It requires an attentive driver and says the feature does not make the vehicle autonomous. Tesla also warns that the functions available vary with the vehicle’s configuration, hardware, software and region.4
These are different products and descriptions, not a comparison of their performance. They show why a demonstration of steering, a confident product name or a driver-monitoring camera cannot answer the responsibility question on its own.
Help with steering and speed can be welcome even while you remain involved in the journey. The mistake is purchasing that help to meet a need that includes not supervising traffic. Those are different benefits, and they deserve different evidence.
Level 3 keeps a person available to take over
Conditional automation introduces a different role. While the feature operates within its conditions, the system handles the driving task. A person must nevertheless remain available to resume driving when required.12 That is a substantial distinction from continuous supervision, but it also differs from being an ordinary passenger.
The conditions are part of the feature. In a December 17, 2024 announcement, Mercedes-Benz described German approval for its DRIVE PILOT update, permitting operation up to 95 km/h on motorways under specified conditions. The same announcement explains that the system can return the driving task to the person.5
Those conditions belong to that version and market. Check the approval, software and operating conditions for the car you would actually use.
For an actual vehicle, the manual and local rules govern what the person must do and which other activities, if any, are permitted. Do not infer permission to look away, use a phone or sleep from the words hands-free or Level 3.
Apply the feature to a whole journey
Imagine a regular trip that starts on local streets, joins a motorway and ends in a busy town centre. A feature covering the middle section could be useful even if you drive both ends. It would not turn the whole journey into passenger travel.
Ask for the exact feature’s coverage and conditions for that route, including the return trip. Then establish the person’s role whenever it is engaged, how its status is shown and what the instructions require when it stops operating. The answers should describe the version you would actually use, rather than a different system demonstrated elsewhere.
If your aim is to get a relative to appointments without asking them to drive, assistance requiring their continuous supervision does not meet the need. Investigate a passenger service that actually covers the journey, with suitable access and support. Level 4 can serve a limited operation without requiring Level 5’s much broader scope.12 Neither label establishes that a particular service will collect your relative or accommodate them.
We would choose the required human role first, then compare features or services that cover the real journey. If you want help while driving, look closely at the assistance and duties that remain. If you want to travel as a passenger, make the absence of a supervising-driver requirement a condition of the search.
Our look at what people want from their next vehicle explores that wider choice. For driving automation, the decisive improvement is the specific part of the job you can hand over. Establish that before paying for the name.
